General Agreement
When ordering GLOBAL INDIA EXPRESS PRIVATE LIMITED PRIVATE LIMITED’s services, you, as the “Shipper”, are agreeing—on your behalf and on behalf of anyone else with an interest in the shipment—that these Terms and Conditions shall apply from the time that GLOBAL INDIA EXPRESS PRIVATE LIMITED PRIVATE LIMITED accepts the shipment, unless otherwise agreed in writing by an authorized officer of GLOBAL INDIA EXPRESS PRIVATE LIMITED PRIVATE LIMITED.
“Shipment” refers to all documents or parcels that travel under one waybill and which may be carried by any means GLOBAL INDIA EXPRESS PRIVATE LIMITED PRIVATE LIMITED chooses, including air, road, or any other carrier.
A “Waybill” includes any label produced by GLOBAL INDIA EXPRESS PRIVATE LIMITED PRIVATE LIMITED automated systems, waybill, or consignment note, and shall incorporate these Terms and Conditions.
Every shipment is transported on a limited liability basis as provided herein. If the Shipper requires greater protection, insurance may be arranged at an additional cost. (Please refer to the details below for further information.)
“GLOBAL INDIA EXPRESS PRIVATE LIMITED PRIVATE LIMITED” means any member of the GLOBAL INDIA EXPRESS PRIVATE LIMITED PRIVATE LIMITED network.
1. Customs, Exports and Imports
GLOBAL INDIA EXPRESS PRIVATE LIMITED may undertake the following actions on behalf of the Shipper in order to facilitate its services:
- Complete any required documentation, amend product or service codes, and pay duties or taxes as required by applicable laws and regulations.
- Act as the Shipper’s forwarding agent for customs and export control purposes, and as Receiver solely for the purpose of appointing a customs broker to handle clearance and entry.
- Redirect the shipment to the Receiver’s import broker or to another address if requested by an individual GLOBAL INDIA EXPRESS PRIVATE LIMITED reasonably believes to be authorized.
Please note the following:
- Any duties, taxes, or warehouse charges at the destination or at origin (in case the goods return) will be charged to the Shipper if the Consignee refuses to pay. These charges are subject to the forwarding network and the destination country's customs policy.
- Global India Express Private Limited is not responsible for any duties, taxes, or related charges.
- The Shipper is required to provide two to three valid address proofs and a photo ID as per Global India Express Private Limited requirements. If these documents are not submitted, the shipment may be delayed or held due to incomplete documentation or customs clearance issues.
- If a shipment is detained or stopped by customs at origin or destination, the Shipper/Consignee is responsible for providing the necessary documents or information. In such cases, the Shipper/Consignee may also be required to appear before customs authorities if advised by Global India Express Private Limited.
- Global India Express Private Limited will not be held liable for any delays or issues arising from such detentions.
2. Unacceptable Shipments
The Shipper confirms that their shipment is acceptable for transportation. However, a shipment will be deemed unacceptable and may be refused, held, or returned if it meets any of the following conditions:
2.1 Hazardous or Prohibited Items
The shipment is classified as hazardous material or dangerous goods, or contains prohibited or restricted items as defined by:
- IATA (International Air Transport Association)
- ICAO (International Civil Aviation Organization)
- ADR (European Agreement concerning the International Carriage of Dangerous Goods by Road)
- Any applicable national or international authority or regulatory body
2.2 Missing Customs Declarations
The shipment lacks a required customs declaration under applicable customs laws and regulations.
2.3 Prohibited Contents
The shipment contains any of the following:
- Counterfeit goods
- Animals
- Bullion, currency, or tax stamps
- Negotiable instruments in bearer form
- Precious metals or stones
- Real or imitation firearms, firearm parts, weapons, explosives, or ammunition
- Human remains or body parts
- Pornographic material
- Illegal drugs or narcotics
2.4 Unsafe or Improper Packaging
GLOBAL INDIA EXPRESS PRIVATE LIMITED may, at its sole discretion, refuse any shipment it deems:
- Unsafe or illegal to transport, or
- Inadequately or improperly packaged
If a shipment is found to contain prohibited, restricted, or undeclared goods (without prior disclosure), GLOBAL INDIA EXPRESS PRIVATE LIMITED reserves the right to detain such goods. If necessary, GLOBAL INDIA EXPRESS PRIVATE LIMITED may escalate the matter to the appropriate Indian legal authorities or regulatory bodies, including narcotics control, local police, or other relevant departments. Also, Global India Express Private Limited may charge a fine or penalty to the sender/receiver.
3. Deliveries and Undeliverable Shipments
Shipments cannot be delivered to P.O. boxes or postal codes. Deliveries are made to the recipient address provided by the Shipper (which, in the case of mail services, is considered the first receiving postal service), but not necessarily to the named recipient personally.
Shipments sent to addresses with a central receiving area will be delivered to that designated area. If a shipment is deemed unacceptable, is undervalued for customs purposes, or if the Receiver cannot be reasonably identified, located, or refuses to accept or pay for the delivery, GLOBAL INDIA EXPRESS PRIVATE LIMITED will make reasonable efforts to return the shipment to the Shipper at the Shipper’s expense.
If the return is not possible, the shipment may be released, disposed of, or sold by GLOBAL INDIA EXPRESS PRIVATE LIMITED or its associated forwarding network or agency. This will be done without any liability to the Shipper or any other party, and the proceeds will be used to cover service charges and related costs, including but not limited to destination duties and taxes, warehouse fees, and disposal charges.
All such charges will be billed to the Shipper, who must also provide any necessary documentation or information related to the shipment if required.
4. Inspection Policy – GLOBAL INDIA EXPRESS PRIVATE LIMITED
GLOBAL INDIA EXPRESS PRIVATE LIMITED reserves the right to open and inspect any shipment without prior notice. The company is not responsible if a shipment is opened for physical inspection by customs authorities at the origin or destination, as required by any authorized regulatory body.
Additionally, we retain the full right to open and physically inspect all packages at our premises before dispatching them outside India, strictly for security reasons.
All customer shipments are thoroughly checked 100% at our office premises for safety and compliance purposes.
5. Shipment Charges
5.1 Chargeable Weight
Shipment charges by GLOBAL INDIA EXPRESS PRIVATE LIMITED are calculated based on the greater of actual weight or volumetric weight. All shipments are subject to re-weighing and re-measurement by the company to confirm the correct chargeable weight.
5.2 Responsibility for Charges
The Shipper is fully responsible for paying or reimbursing GLOBAL INDIA EXPRESS PRIVATE LIMITED for all charges related to the shipment. This includes, but is not limited to:
- Freight charges
- Ancillary service fees
- Customs duties and taxes
- Third-party handling or service costs
- Additional costs due to reclassification or re-measurement
- Charges incurred due to the shipment being unacceptable for transport or non-compliant with regulations
5.3 Unacceptable Shipment Costs
If a shipment is deemed unacceptable for transport due to regulatory, safety, or packaging issues, the Shipper is liable for all resulting costs, including return shipping, storage, disposal, or penalties.
5.4 Claims for Damages or Expenses
In case of damages, fines, or any other expense claims, the Shipper must adhere to the procedures outlined in the Claim Policy to initiate and support the claim process.
6. GLOBAL INDIA EXPRESS PRIVATE LIMITED’s Liability
GLOBAL INDIA EXPRESS PRIVATE LIMITED is dedicated to providing exceptional and customer-friendly service through our team of trained and qualified professionals. Our personnel handle the pickup of goods with care and ensure reliable transportation up to the point of delivery.
Pickup Executives are responsible only up to the point of shipment collection. After the shipment is collected from the shipper, all further inquiries, tracking requests, or concerns should be directed to any official office or branch of GLOBAL INDIA EXPRESS PRIVATE LIMITED.
Pickup Executives are not liable for any issues, damages, delays, or queries that arise after collection of the shipment.
7. Time Limits for Claims
All claims must be submitted in writing. Verbal claims will not be accepted by GLOBAL INDIA EXPRESS PRIVATE LIMITED.
Claims must be submitted within three (3) days of:
- The delivery date, or
- The pickup date (if the shipment has not been forwarded or connected), based on the date GLOBAL INDIA EXPRESS PRIVATE LIMITED accepted the shipment.
Failure to submit a claim within this time frame will release GLOBAL INDIA EXPRESS PRIVATE LIMITED from any liability.
Claims must be made by the authorized shipper and must include:
- The AWB (Air Waybill) copy
- A valid complaint number from the delivery network (if the shipment was delivered)
8. Shipment Insurance
GLOBAL INDIA EXPRESS PRIVATE LIMITED can arrange insurance coverage for the shipper, protecting the shipment against loss or physical damage up to the actual cash value. To avail insurance, the shipper must either:
- Complete the insurance section on the front of the waybill, or
- Formally request insurance from GLOBAL INDIA EXPRESS PRIVATE LIMITED and pay the applicable premium.
- Shipment insurance does not cover indirect losses or damages, including any losses arising from delays.
- In case of shipment loss during transit or by our vendor/carrier, the maximum claim value will be limited to $100 USD or the invoice value, whichever is less, plus the freight charges paid.
- No claims will be accepted for shipment damage.
Recommendation for Valuable Goods
We strongly recommend that customers insure valuable goods through third-party insurance providers for better protection. Several reputable marine cargo insurance companies in India include:
- Bajaj Allianz
- TATA AIG
- HDFC ERGO
- New India Assurance
- Bharti AXA
- ICICI Lombard
- United India Assurance Co. Ltd.
Platforms like Policybazaar and Bankbazaar list many insurance providers, and the Insurance Regulatory and Development Authority of India (IRDAI) maintains a comprehensive list of general insurance companies, including Universal Sompo and Reliance General.
Please choose an insurance company based on your own research and requirements.
9. Shipment Damage and Packaging Policy
Global India Express Private Limited is committed to delivering your goods safely; however, we do not accept responsibility for any damage claims during transit. Shipments pass through multiple carriers and handlers within our delivery network, making it impossible for us to guarantee damage-free delivery.
To protect your items, please ensure your packaging is strong, secure, and appropriate for the nature of the shipment.
For shipments packed by us, we provide basic carton boxes and tape as a courtesy, but this may not be sufficient for fragile or delicate goods.
If you are shipping fragile or sensitive items, we strongly recommend using professional packing services to ensure your shipment is properly protected throughout the transit process.
10. Delivery and Shipment Delay Policy
1. Approximate Delivery Schedules
GLOBAL INDIA EXPRESS PRIVATE LIMITED provides estimated delivery schedules based on standard transit times and carrier performance. These delivery times are only approximate and do not constitute a guaranteed delivery date or time.
2. No Contractual Guarantee
The estimated delivery timelines are for informational purposes only and do not form part of any contractual obligation between GLOBAL INDIA EXPRESS PRIVATE LIMITED and the shipper or receiver.
3. Liability for Delays
GLOBAL INDIA EXPRESS PRIVATE LIMITED will not be held liable for any loss, damage, or additional costs incurred due to delays in shipment delivery.
4. Customs Clearance Impact
All shipments are subject to customs inspection and clearance procedures in both the origin country (India) and the destination country. Customs authorities may impose additional requirements, inspections, or delays.
5. Delays Beyond Control
Delays can occur due to factors beyond the control of GLOBAL INDIA EXPRESS PRIVATE LIMITED, including but not limited to:
- Customs inspections and clearance delays
- Regulatory hold-ups or legal checks
- Carrier or network disruptions
- Political or environmental events affecting transport
- Third-party partner or vendor delays
6. No Guarantee on Customs Timing
GLOBAL INDIA EXPRESS PRIVATE LIMITED cannot guarantee the duration of customs clearance or influence customs decisions. Clearance times vary by country, shipment contents, and compliance with import regulations.
7. Efforts to Expedite Shipments
While we make every reasonable effort to prioritize and expedite shipments through customs and transport networks, some delays are unavoidable due to regulatory or operational reasons.
8. No Claims for Delay
Due to the unpredictable nature of customs and international shipping, no claims or refunds will be accepted for shipment delays, regardless of the cause or duration of the delay.
9. Customer Responsibility
Customers are advised to allow ample time for delivery, especially when shipping items that are time-sensitive or subject to strict deadlines. Planning for possible delays is recommended.
11. Circumstances Beyond Global India Express Private Limited's Control
GLOBAL INDIA EXPRESS PRIVATE LIMITED is committed to the safe and timely delivery of shipments. However, we shall not be held liable for any loss, damage, or delay resulting from circumstances or events beyond our reasonable control. These include, but are not limited to, the following:
11.1 Natural Disasters and Acts of God
- Earthquakes
- Floods
- Cyclones or hurricanes
- Storms
- Fog or severe weather conditions
These natural events can disrupt transportation networks and customs operations, leading to unavoidable delays or damage.
11.2 Force Majeure Events
- War or armed conflict
- Terrorist acts or threats
- Riots or civil disturbances
- Embargoes or sanctions
- Plane crashes or airspace closures
- Government-imposed restrictions or lockdowns
- Industrial actions, labor strikes, or work stoppages
Such events fall outside the control of GLOBAL INDIA EXPRESS PRIVATE LIMITED and may severely impact the shipment's handling, movement, or delivery.
11.3 External Interference or Third Parties
Acts or omissions by parties not employed or directly contracted by GLOBAL INDIA EXPRESS PRIVATE LIMITED, such as:
- The Shipper or Receiver
- Third-party couriers or transport agents
- Customs authorities or other government officials
- Any person or organization involved in handling, inspecting, or processing the shipment
11.4 Inherent Nature of the Shipment
- Any defect, vulnerability, or natural characteristic of the goods being shipped (e.g., perishability, fragility, instability), even if GLOBAL INDIA EXPRESS PRIVATE LIMITED is made aware of it in advance.
- Loss or damage resulting from improper packaging or unlabeled hazardous items.
11.5 Electrical or Magnetic Interference
- Damage, alteration, or erasure of electronic or magnetic media
- Damage, alteration, or erasure of photographic images, data, or recordings
GLOBAL INDIA EXPRESS PRIVATE LIMITED is not responsible for loss of digital data or damage caused by exposure to electromagnetic or x-ray screening during customs/security checks.
12. International Conventions
1. Applicability of International Conventions
- If the shipment is transported by air and involves a destination or stop in a country other than the country of origin, the transport shall be governed by:
- The Montreal Convention (1999), or
- The Warsaw Convention (1929), as amended, whichever is applicable.
- For international road transportation, the terms may be governed by the:
- Convention for the International Carriage of Goods by Road (CMR).
These conventions may impose limitations on the carrier’s liability, even in cases of loss, damage, or delay.
2. Limitation of Liability
- The carrier’s liability is limited by weight or the nature of the goods, unless a higher declared value is agreed upon and insured in advance.
- Claims for compensation must follow the guidelines and limitations set forth in the respective conventions.
3. Repackaging During Import/Export
- In certain situations, repackaging may be required for customs compliance, safety, or transportation efficiency during import or export.
- GLOBAL INDIA EXPRESS PRIVATE LIMITED reserves the right to repack shipments as needed, without prior notice to the shipper or receiver.
- Any charges incurred for repackaging, as well as additional weight charges resulting from new packaging materials or dimensions, will be payable by the shipper or consignee.
- All boxes are opened for security purposes to inspect the items, and then re-packed. No claims will be entertained regarding repackaging.
13. Shipper's Warranties and Indemnity
- All information provided is complete and correct: The shipper must make sure that all the details they give are true and nothing is left out.
- Shipment was prepared in a secure place by the shipper’s own staff: The goods must be packed in a safe location, and only the shipper’s employees should be involved.
- Reliable staff were used to prepare the shipment: The people who handled the goods must be trustworthy and properly trained.
- Shipment was protected from tampering or interference: The shipper must ensure that no one could open or mess with the shipment before it reached Global India Express Private Limited.
- Shipment is correctly labeled, addressed, and packed safely: The box or package should have the correct details written on it and be packed carefully to avoid damage.
- All laws for customs, import, and export are followed: The shipper must make sure the shipment meets all the legal rules for moving goods between countries.
- Waybill is signed and the agreement is legally binding: The shipper’s authorized person must sign the waybill (shipping document), and by doing so, the shipper agrees to follow all the terms and conditions.
14. Global India Express Private Limited – Responsibility Disclaimer
1. Shipment Delay, Return, or Rerouting
- GLOBAL INDIA EXPRESS PRIVATE LIMITED shall not be held liable if the shipment is:
- Delayed in transit due to operational, regulatory, or customs issues.
- Returned to the shipper for reasons such as failed delivery attempts, incorrect address, or refusal by the receiver.
- Rerouted due to incorrect or incomplete delivery information.
2. Return Shipping Costs
- If the shipment is returned to the origin due to:
- Incomplete or incorrect address,
- Receiver unavailability,
- Customs clearance failure,
- Refusal to accept the package,
3. Address Correction & Remote Area Charges
If a shipment requires address correction or delivery to a remote area, any additional charges levied by the carrier or delivery network will be invoiced to the shipper.
4. Customs Duties and Taxes
- In cases where the receiver refuses to pay customs duties, taxes, or other import charges, the responsibility for those charges automatically shifts to the shipper.
- These charges may include:
- Import/export duties,
- Brokerage fees,
- Storage or clearance-related penalties.
5. Shipper’s Acknowledgement
- Provide accurate and complete shipping information,
- Accept full financial responsibility for charges resulting from returns, corrections, or customs issues,
- Acknowledge that GLOBAL INDIA EXPRESS PRIVATE LIMITED is not liable for delays or failures arising from the above scenarios.
15. Shipment Routing and Handling
1. Routing Authority
- Global India Express Private Limited reserves the right to determine the most suitable forwarding route for any shipment.
- Routing may involve diversions, multiple transit points, or intermediate hubs to facilitate faster or safer delivery.
2. Repacking Without Prior Notice
- Shipments may be repacked without prior notice for customs inspections, transportation safety, or space optimization.
3. Shipment Not Forwarded
- Shipper must collect unforwarded shipments from a local branch.
- No return to original address will be provided.
4. Acceptance of Routing and Diversions
- Shipper agrees to all routing and logistics decisions including third-party handling and use of transit hubs.
5. Shipper-Initiated Routing or Address Corrections
- Special routing or correction charges will be billed to the shipper as per company policy.
6. No Liability for Delays from Rerouting
Global India Express Private Limited is not responsible for delays due to rerouting or repackaging.
16. Governing Law and Jurisdiction
1. Jurisdiction
All disputes shall fall under the exclusive jurisdiction of courts located in Delhi, India.
2. Legal Venue
Delhi courts are the legal venue for all contractual or delivery-related claims.
3. Non-Exclusive Jurisdiction
Global India retains the right to enforce legal rights in any competent jurisdiction, with preference for Delhi.
4. Agreement to Submit
Shippers and receivers agree to submit to Delhi jurisdiction and waive any objection.
5. Applicable Law
All services are governed by Indian law unless required otherwise by destination regulations.
17. Shipment Return Policy
Returned shipments must be collected from the nearest branch. Free warehouse storage for 15 days. Beyond that, storage charges apply.

C. Additional Charges: Manpower, cancellation, labor, and other services – non-negotiable, billed at cancellation time.
Important Note: Shipper pays A + B + C + D charges. GST applicable. All services governed by Delhi jurisdiction.
17. Pickup Services – Terms & Conditions
We offer free pickup services for small shipments from the following locations:
Delhi, Jaipur, Bangalore, Chennai, Lucknow, Mumbai, Noida, Gurgaon, Ghaziabad, Faridabad, Manesar, and Sahibabad.
For bulk cargo or large shipments, labor and handling charges will apply as per the quotation provided by the sales team.
Pickup from Other Locations
- Pickup from other cities may incur additional charges as per company’s standard rates.
Pickup Cancellation Policy
- If pickup is arranged from a non-standard location and later cancelled, sender must pay:
- Pickup charges
- Re-forwarding charges
- Any applicable cancellation fees
All charges applied as per company cancellation policy.
18. Important Shipping Terms for Food, Fragile & Liquid Item Delivery
- No responsibility for food/liquid damage
- No refund for spoiled/melted items even if delayed
- Transit times are estimates only, not guarantees
- Fragile or perishable items shipped at sender’s risk
- By shipping, sender agrees to these terms
19. Medicine Courier – Delivery Terms & Conditions
- Subject to customs clearance in destination country
- Indian customs documentation handled by Global India Express
- Receiver must provide any additional documents if required by destination customs
- No refunds for customs-related delivery failure
- Return charges, import duty, and fees for rejected shipments are shipper/receiver’s responsibility
20. LCL Shipping – Door to Port Terms & Conditions
- Scope of Service: Limited to transport from pickup in India to destination port. No delivery beyond port.
- Destination Charges: Receiver must pay unloading, handling, clearance, and port fees directly.
- No Liability: We are not responsible for destination port charges or coordination post-arrival.
- Included in Quote: Sea Freight, Local Clearance, IHC, THC, Labour, India-side Docs, Trucking.
- Receiver Must Pay: All additional destination charges as per actuals. No dispute entertained.
21. Import to India – Terms & Conditions
- Quotation & Billing: Final billing based on actual or volumetric weight after customs at Mahipalpur.
- Weight Verification: Disputes must be resolved at Mahipalpur office in person.
- Prepayment: Full freight, customs, and taxes must be paid before delivery.
- Delivery Time: 3–5 business days post-payment depending on location & third-party network.
- Customs Duty:
- All duties payable by receiver as per official receipt.
- If prepaid by us, billed to customer with vendor receipt.
- Freight still payable if restricted or detained by customs.
- No liability if documents not provided and shipment seized.
